Two labs published results eight days ago that, read together, say something uncomfortable about the most popular shape a supplement comes in. Consumer Reports tested seventeen prenatal vitamins and found that fifteen of them contained at least one nutrient in an amount different from what the label promised. Across 126 individual nutrient measurements, roughly a third fell outside the ranges the industry itself treats as acceptable. Separately, NOW Foods bought thirty vitamin C gummy products off Amazon, ran them through high performance liquid chromatography at two labs, and found five brands claiming a thousand milligrams or more per gummy that contained, in total, less than two milligrams.
Less than two milligrams. Under one percent of the claim. In some samples the instrument read zero.
The short answer
Nobody verifies that the vitamin is in the gummy before you buy it. Not the manufacturer, necessarily, and not the Food and Drug Administration, which has no authority to approve a dietary supplement before it goes on sale. What the law requires is that a company write down a specification and keep records showing it has a system for meeting one. Whether anyone measures the finished product is, in a meaningful sense, optional. That gap is not a scandal so much as the design, and the gummy format sits in the worst possible place inside it.
Why a gummy is a harder object than a pill
A tablet is dry, compressed powder. A gummy is candy: gelatin or pectin, fifteen to twenty percent water, acidic, sweetened, flavored, and physically uneven from one piece to the next. Every one of those properties works against the nutrient inside it.
Water is the main culprit. In a dry tablet, molecules cannot move, so they cannot react. In a wet gel they can, and they do. The United States Pharmacopeia, the standards body that sets quality specifications for medicines and supplements, put it plainly in its own stakeholder documents: vitamins are unstable in the chewable gel matrix because of high water content and low pH. USP added a water activity test with a limit of 0.75 and a pH limit of 4.5 to its chewable gels monograph work precisely because of this.
Heat during manufacture is the second problem. Gummy production runs hot enough to compromise the ingredients consumers are most excited about, which is why probiotics, certain enzymes and omega 3 oils are difficult to deliver in gummy form and why fish oils in that format risk going rancid. The third problem is space. Binders, sweeteners, humectants and pH adjusters all compete with the active ingredient for room inside a piece you can chew, which caps how much of anything you can load in.
The fourth is the one nobody mentions on the packaging. A gummy is not homogeneous. Two gummies from the same bottle can differ. A tablet is pressed from a single blended powder and is far more consistent piece to piece.
Manufacturers deal with all of this the same way: overage. They dose high at the factory so the product still meets its label at expiration, because that is the standard the product is measured against. NOW's internal stability work suggests vitamin C can lose about twenty percent of its potency per year in a gummy. Four products in NOW's round that passed on the day of testing were projected to fall below label before their expiration dates.
The number that should change how you shop
Here is where gummy vitamin potency stops being a manufacturing footnote. USP's acceptance criteria are not the same for gummies as for pills. For folic acid, a tablet or capsule is expected to fall between 90 and 150 percent of its labeled amount. A chewable gel is permitted a range of 90 to 245 percent, and up to 255 percent when declared overage is accounted for. For vitamin C, tablets run 90 to 110 percent; gummies are allowed 90 to 150.
Read that again. A compliant gummy can legitimately contain more than twice the folate on its label. USP's own documents acknowledge the consumer facing hazard: overage not reported on the label can mislead people about how much of a nutrient they are consuming. ConsumerLab, which runs its own testing program, has declined to accept the wider gummy allowances in its certification, which tells you what an independent tester makes of them.
And after all that latitude, Consumer Reports still found four of eight gummy prenatals below label on folate. One A Day Prenatal Gummy measured at 28 percent of its stated folic acid. Folate is not a discretionary nutrient in early pregnancy. It is the one with the clearest evidence behind it and the narrowest window in which it matters.
The iron problem, which is not a scandal
Consumer Reports also found that only seven of seventeen prenatals contained iron, and that no gummy did. This one deserves a fair reading. Iron is nearly impossible to put in a gummy. It tastes metallic and flavor masking has limits. It is redox active, so in a wet acidic gel it catalyzes the oxidation of everything around it, vitamin C included, and discolors the product. Minerals disrupt the gel structure itself, forcing formulators to add more gelling agent to hold the piece together. And prenatal iron doses are large relative to what a chewable piece can carry alongside everything else.
So the absence of iron from a gummy prenatal is a physical constraint, disclosed on the panel, not a deception. The failure is subtler. A person buying something labeled prenatal vitamins reasonably assumes it contains the nutrients prenatal care is about. Nobody told her the format made one of them impossible.
What the rules actually require
Under the current good manufacturing practice rule for supplements, a manufacturer must establish specifications for components, for in process production and for the finished batch, covering identity, purity, strength and composition. It must conduct at least one test to verify the identity of any dietary ingredient. Identity, note, not amount.
For finished batch potency, the rule permits verifying a subset of batches selected through a statistical sampling plan. It also permits a manufacturer to document why component and in process testing will ensure the specification is met without testing the finished batch at all, provided the company's own quality control staff review and approve that documentation. This is supplement label accuracy as a paperwork system rather than a measurement system, and it is legal.
Government auditors have found the same pattern before. A Government Accountability Office report on prenatal supplements documented amounts of key nutrients differing from product labels, which means the Consumer Reports finding is a confirmation rather than an outlier.
"Transparency can be a problem when manufacturers handle their own verification," said Eric Boring, the Consumer Reports chemist who led the testing.
Two things to hold against the testers themselves
NOW Foods is a supplement manufacturer that tested its direct competitors, publicized the results, and launched its own vitamin C gummies in April 2026. Its product was among those tested and passed. That is a real conflict and it should be stated out loud, including by the trade press that covered the results without disclosing it. It does not make the chromatography wrong. It does mean you should weigh the framing separately from the data.
The second caveat is about generalization. The twelve failing products were obscure marketplace brand names, the kind that appear and vanish on a platform listing. Five established brands NOW also tested, including Nature's Way, Nordic Naturals and Solgar, met their claims. This is a third party seller problem more than a shelf problem, and describing it as an industry wide collapse would overstate it.
Dan Richard, who runs global sales and marketing at NOW, has been raising this for years. "neither Amazon nor FDA have taken steps to address the issues NOW has raised," he said of the testing rounds. Amazon did announce in January that all supplement sellers must demonstrate compliance through accredited third party facility audits, expanding a requirement that previously covered only high risk categories. Read the scope carefully: it audits the factory. It does not require anyone to test whether the vitamin C is in the gummy. Amazon's new policy would not have caught the five brands measuring under two milligrams.
How to check, in the order that matters
Start with format. If a nutrient has a narrow therapeutic window or a hard requirement, folate in pregnancy, iron, anything a clinician told you to take at a specific dose, buy it as a tablet or capsule. Save gummies for the nutrients where being somewhat off does not matter much and where you will otherwise skip the dose entirely, which is a real consideration and not a trivial one.
Then look for third party testing marks, and understand what each one covers. USP Verified confirms the product contains the ingredients listed in the declared amounts, screens for specified contaminants, checks that it breaks down in the body, and audits the facility, with off the shelf surveillance testing afterward. Bear in mind that for a gummy, declared potency means compliance with the chewable gel range, folate ceiling and all. NSF Certified for Sport verifies label claims, runs a toxicology review, and screens for hundreds of banned substances; it is the mark recognized by the major professional leagues. ConsumerLab buys products at retail rather than accepting manufacturer samples, which is structurally the most independent approach, though its reviews run on multi year cycles rather than continuously.
Be most skeptical of a seller supplied certificate of analysis. A COA may cover a different lot, may describe an ingredient rather than the finished product, and may use a method that flatters the result. NOW's report makes this point directly: non specific spectrophotometric assays can return inflated potency readings when sugars and flavorings interfere, where chromatography measures ascorbic acid specifically. A certificate showing full potency by the wrong method is not necessarily fraud. It may just be a bad measurement producing a pleasant number. Check that the document names the finished product, the specific lot, an accredited laboratory, and a method appropriate to what is being measured.
Finally, treat the expiration date as information rather than decoration. Given vitamin C degradation in a gel matrix, a bottle bought late in its shelf life is a different product than the same bottle bought fresh. What is coming, and what is not
California enacted Senate Bill 646, the first state law requiring routine heavy metal testing for prenatal vitamins with public disclosure of results, which Consumer Reports reports takes effect January 1, 2027. That is a real change and a narrow one: it covers heavy metals in prenatals in one state. It does not require anyone to verify potency in anything.
On heavy metals, incidentally, the Consumer Reports findings were reassuring rather than alarming, and it is worth being precise about why. All seventeen products came in below the threshold Consumer Reports uses, which is derived from California's Proposition 65 maximum allowable daily level, not from any FDA limit, because for lead in supplements no FDA limit exists. Target's Up and Up prenatal averaged 219 parts per billion of lead, Thorne Basic 91.7, Seeking Health Optimal 33.9. Below a level of concern is not the same as absent, and Consumer Reports notes there is no established safe amount of lead at any life stage.
A class action filed in July against the maker of Qunol Ultra Omega 3 alleges the product delivers roughly 404 milligrams of omega 3 per two capsule serving against a label promising a thousand. That is an allegation and nothing has been proven. It is also the mechanism arriving where it usually does in this country, which is court, years after the measurement problem was already known.
The honest summary of dietary supplement regulation in 2026 is this. The system is built on documentation, and documentation is not measurement. Certification programs are voluntary and paid for by the companies that seek them, which means the absence of a seal tells you nothing at all. The one lever a consumer holds is format choice, and it turns out to be a surprisingly powerful one. How to read a supplement label starts, before the ingredients panel, with the question of what shape the thing is in and what that shape does to what is inside it.
None of which means gummies are useless. A gummy you take beats a capsule you forget, and for a general purpose multivitamin the difference between 90 and 130 percent of a nutrient is not going to change anyone's life. Save the scrutiny for the doses that matter. That is where the gap between what the label says and what the bottle holds stops being an annoyance and starts being a problem.
